Legal compliance and discipline and grievance

 

As an employee we have different types of rights that are based on the law. This is very good to recognize and keep in mind if having any mistreatment at your workplace. There are three categories which concerns employee itself. First statutory rights and this for example includes safe work conditions that everyone is entitled to. Secondly contractual rights, meaning that you should have your employment contract achievable, and employee can always appeal to the contract if employer i.e., tries to expand your duties at work without any extra allowance. Last category is including all other rights that employees should have, like privacy for instance (Mejia Gomez, 2016.)




 

Of course, employers also have their rights and by them they are trying to secure the businesses. One example that comes to my mind is probation for the employment. With this method employers ensure that they get to know these new hires in detailed before the permanent job contract starts. After that it is very important that as an employer you constantly monitor your workers behavior. There are unfortunately employees that are not following instructions in purpose. Employer has the right to terminate employment if this continues frequently (Mejia Gomez, 2016.)

 

Unions are always having employees backs and helping them out if there is collision with employer. In my own experience I didn’t think before that it is very beneficial to join trade unions. I know that when I was younger, I didn’t know any employee rights that I am entitled to. My previous workplace I joined the union for the first time, and it was the best decision. Every time when I had some problems with working hours, they helped and advised what to do. 

 




As we can read from the New York Times article how awful the employees’ treatment can get. It is always very hard for that person who faces harassment from their supervisor because it will require a lot of courage to tell the authorities the situation like this. There is always the fear of losing the job even though this is not the case but maybe the supervisor has said something like this and prohibited to tell anyone (Christopher Mele & Al Baker, 2016.)

 

The video of the receipt scandal was a good example how customers believe that they can say or behave as they like. Clearly the waitress in this news tried hers best to serve as professionally as possible when considering that it was a very busy night at this restaurant. It was a pure embarrassment towards the employee on the customer side. Even though the service was slow it doesn’t mean that it is okey to be this rude (Fox News, 2015.)

 

I have had many experiences regarding mistreatment or even insults from customers so that nowadays I don’t even startle if it happens. One time at my work someone started to shout and get personal so that it escalated to that point that I had to call guard to discharge that customer from my workplace. By following procedures and not taking anything personally people at customer service field can manage these kinds of situations and handle them with grace.
